By accessing or using the website, you confirm that you have read, understood and accepted these Terms and Conditions. If you do not agree with these rules, please do not use the website.
2. Purpose of the website
The website presents RECRIMCO services, including recruitment, selection, information, counselling, employment placement for work abroad, operational HR support, onboarding, document administration, support relating to payroll and timekeeping data, document audits, operational support, training and related services.
The information published on the website is general and provided for informational purposes only. It does not constitute a firm offer, an employment placement agreement, a services agreement, an individual employment contract, or legal, tax or accounting advice, and merely accessing the website does not create a contractual relationship between the user and RECRIMCO.
Firm job offers for work abroad, within the meaning of Article 11 of Law no. 156/2000, will be communicated to candidates only as part of the employment placement procedure and will contain all information required by law.
3. Website users
The website is intended for companies interested in recruitment or HR support services, candidates interested in employment opportunities abroad, partners, suppliers and other individuals or organisations interested in RECRIMCO’s activities.
Users must use the website in good faith, for lawful purposes and without adversely affecting its operation or security or RECRIMCO’s reputation.
4. Services for companies
RECRIMCO may provide companies with recruitment, selection, information, counselling, employment placement and direct hiring support, as well as operational or administrative HR services, under separate agreements. The commercial terms, fees, payment terms, warranties, limitations and responsibilities of the parties are established exclusively in the agreements and annexes signed with each client company.
RECRIMCO does not become the employer of a client company’s personnel, does not assume the client company’s statutory obligations as an employer, and does not make final decisions concerning the hiring, amendment, suspension, disciplinary action or termination of employment relationships, unless it has been granted an express, written and limited mandate in accordance with the law.
5. Services for candidates and job seekers
For Romanian citizens interested in working abroad, RECRIMCO may provide information, counselling and employment placement services in accordance with Law no. 156/2000 and the applicable implementing rules.
RECRIMCO is not the candidate’s employer and does not unilaterally determine the salary, working hours, place of work or specific working conditions. If the placement process is successful, the employment relationship is established directly between the candidate and the foreign employer identified in the individual offer.
Information, counselling, recruitment, selection and employment placement services are provided to candidates free of charge. RECRIMCO does not charge candidates any commission, fee, charge, security deposit, advance payment, penalty or other cost for employment placement relating to work abroad.
No payment may be requested from a candidate as a condition for accessing employment placement services, being presented to a foreign employer, signing placement documents or continuing the recruitment process.
These services are provided to candidates free of charge in accordance with Article 8(5) of Law no. 156/2000. RECRIMCO does not charge candidates any commission, fee, charge or other cost for employment placement relating to work abroad.
6. Employment placement agreement
For employment placement relating to work abroad, RECRIMCO enters into a written employment placement agreement with each candidate. The agreement includes at least the information required by Article 11(1)(a) and points (d) through (ș) of Law no. 156/2000, in accordance with Article 8(4) of the same law.
7. Job offers and individual annexes
Information about job opportunities published on the website or initially communicated is general in nature. A vacancy advertised on the website does not, in itself, constitute a firm job offer within the meaning of Romanian legislation governing foreign employment placement. A specific offer is presented to the candidate through a firm job offer or an individual offer annex containing the information required by law, such as the employer, role, place of work, duration of employment, conditions of employment and termination, working and rest time, remuneration, leave, accommodation, transport, repatriation, taxes and competent authorities.
The candidate is given the minimum statutory period in which to review the offer: at least five days for the first placement procedure and at least two days if the candidate has previously received employment placement services. The candidate may not be deemed to have accepted the firm job offer before the applicable minimum period has expired, except where expressly permitted by law.
RECRIMCO ensures that the firm job offer is explained to the candidate in detail, in accordance with Article 11(9) of Law no. 156/2000.
Publication of a vacancy on the website does not guarantee employment, acceptance of the candidate, continued availability of the offer or the conclusion of an employment contract. Employment depends on the decision of the foreign employer, the candidate’s eligibility, the documents available, the applicable law and the specific terms of the offer.
8. Forms, CVs and communications
If the website allows users to submit forms, CVs or documents, the user confirms that the information provided is accurate, complete and up to date and that the user is entitled to submit it. RECRIMCO may refuse to process requests that are incomplete, non-compliant or appear to be fraudulent.
Communications may take place by email, telephone, WhatsApp, electronic platforms or other agreed means, in accordance with the Privacy Policy.
9. User obligations
Users must not submit content that is unlawful, false, offensive, discriminatory, abusive, infected with malware or otherwise infringes the rights of others. Users must not attempt to gain unauthorised access to RECRIMCO systems, copy content without authorisation, automatically extract data, compromise the security of the website or use another person’s identity.
10. Intellectual property
The text, structure, design, graphic elements, trademarks, names, documents, procedures, presentation templates and other materials published on the website belong to RECRIMCO or its partners, unless otherwise stated. Copying, reproducing, distributing, modifying or using such materials for commercial purposes without RECRIMCO’s written consent is prohibited.
11. Third-party links
The website may contain links to third-party websites or platforms. RECRIMCO does not control and is not responsible for the content, security, availability or policies of those websites. External links are accessed at the user’s own risk.
12. Limitation of liability
RECRIMCO uses reasonable efforts to ensure that the information on the website is accurate and up to date, but does not guarantee that the website will always be available or error-free or that the information will be complete for every specific situation.
To the extent permitted by law, and without prejudice to RECRIMCO’s statutory obligations as a foreign employment placement agency or its obligations concerning the protection of personal data, RECRIMCO is not liable for indirect losses, loss of profit, operational losses, decisions made solely on the basis of general information available on the website, temporary unavailability of the website, cyberattacks by third parties or the content of external platforms. Any contractual liability is governed by the applicable agreement signed by the parties.
Nothing in these Terms and Conditions limits the mandatory statutory rights of consumers, candidates, data subjects or workers where such rights are provided by law.
13. Data protection
The processing of personal data through the website and in connection with RECRIMCO services is carried out in accordance with the Privacy Policy published on the website. Users should read the Privacy Policy before submitting personal data or documents.
Personal data is also processed in accordance with Regulation (EU) 2016/679 (GDPR), Law no. 190/2018 and the applicable national data protection legislation.
As a foreign employment placement agency, RECRIMCO processes candidates’ personal data in accordance with Article 7 of Law no. 156/2000, the GDPR and the applicable national implementing legislation.
14. Confidentiality
Commercial, operational, financial, technical, legal, payroll and recruitment information, data relating to candidates, employees, clients and suppliers, internal procedures and documents communicated in the course of a business relationship may be confidential. Detailed confidentiality arrangements are established in the agreements and contracts signed by the parties.
15. Changes to these Terms
RECRIMCO may amend these Terms and Conditions to reflect legislative, technical, commercial or operational changes. The version published on the website applies from the date of publication.
16. Governing law and disputes
These Terms and Conditions are governed by Romanian law, subject to any applicable mandatory rules. Any dispute will first be addressed amicably. If an amicable resolution cannot be reached, the dispute will be submitted to the competent courts within the territorial jurisdiction of the Târgu Mureș Court of Appeal, unless the law provides for another mandatory jurisdiction.
17. Language of the document
The Romanian-language version is the principal and controlling version. In the event of any inconsistency in interpretation between the Romanian version and a translation into another language, the Romanian version will prevail, unless applicable law requires otherwise.
